Terms of Service

1. Service provider

These Terms of Service govern professional services supplied by:

2. Scope

These Terms apply to the Trader / Investor Profile and Bespoke Market Timing Research described on this website.

They apply together with the written email exchange or individual proposal confirming the scope, deliverables, price, timing and payment terms of a particular engagement. If an individual proposal expressly differs from these Terms, the proposal shall prevail for that engagement.

3. Contracting process

Services are requested by email. A request does not create an obligation for either party.

Before accepting an engagement, the service provider may request the information required to assess feasibility, define the scope and confirm the price and expected delivery schedule.

An engagement begins only when:

• its scope and applicable payment terms have been confirmed in writing;
• the client has expressly accepted them;
• any required payment has been received; and
• the information necessary to begin the work has been supplied.

The service provider may decline a request before acceptance when its scope, timing, subject matter or intended use is not considered appropriate or feasible.

4. Trader / Investor Profile

The Trader / Investor Profile is a personalised analytical report examining characteristic patterns relating to financial decision-making, risk, timing, conviction, uncertainty and execution.

The client must provide an accurate date, time and place of birth. A name or pseudonym may be provided. The client may also identify a particular concern or aspect they would like the report to address.

The current fee is €250, including applicable taxes.

The report is normally delivered as a PDF by email within two business days after the engagement has been accepted, payment received and all required information supplied. Any different delivery date will be confirmed in writing.

The service includes:

• one personalised PDF report;
• one round of reasonable clarifications or factual corrections requested within 30 calendar days of delivery; and
• one optional follow-up call of up to 30 minutes, to be arranged within that same period.

Clarifications do not include a complete reinterpretation, a new profile, additional products or research outside the original scope.

Reports are available in English, Spanish, Portuguese, German and French. Follow-up calls are available in English, Spanish, German and Portuguese.

5. Bespoke Market Timing Research

Bespoke Market Timing Research is defined individually following an initial conversation or email exchange.

The written proposal will identify, as applicable:

• the market or markets covered;
• the relevant exposure, horizon and decision context;
• the analytical scope;
• the initial deliverable and any agreed updates;
• the delivery schedule;
• the fee and payment terms; and
• any limits on revisions, calls or additional analysis.

Research may include time clusters, price levels, technical structure, conditional scenarios and analysis of particular market set-ups or changes in exposure.

Material changes to the agreed markets, horizon, objectives or deliverables may require a revised proposal, delivery schedule and fee.

6. Client responsibilities

The client is responsible for:

• providing complete and accurate information;
• promptly communicating any correction or material change;
• reviewing the agreed scope before acceptance;
• ensuring that the service is lawful and appropriate for their intended use; and
• making their own financial and operational decisions.

The service provider is not responsible for delays or limitations caused by incomplete, inaccurate or late information supplied by the client.

7. Fees and payment

Fees and accepted payment methods are confirmed in writing before the engagement begins. Payment may be made by bank transfer or another method agreed between the parties.

Unless otherwise stated, quoted consumer prices include applicable taxes.

The client is responsible for any charges imposed by their bank, payment provider or currency-conversion service.

No additional work outside the agreed scope will be charged without the client’s prior agreement.

8. Delivery and communications

Reports and research are normally delivered electronically to the email address supplied by the client.

The client is responsible for providing a functioning email address and checking relevant inbox and spam folders. Delivery is considered completed when the material has been sent to the agreed address, unless a delivery failure is reported.

Dates and timeframes are estimates unless expressly confirmed as fixed. If a material delay becomes apparent, the client will be informed as soon as reasonably possible.

9. Corrections and revisions

A factual correction concerns an error in the client information used, a transcription error or another objectively verifiable mistake.

A clarification explains material already contained within the agreed deliverable. It does not require new research or a new analytical interpretation.

Requests falling outside the included clarification or update terms may be treated as additional work and quoted separately.

10. Cancellation and right of withdrawal

Where the client is acting as a consumer, statutory withdrawal rights apply in accordance with applicable law.

A consumer generally has 14 calendar days from the conclusion of a distance contract to withdraw without giving a reason.

If the consumer asks for the service to begin during that period, they must expressly request early performance. If they then withdraw before the service has been fully performed, they may be required to pay an amount proportionate to the work completed up to the time of withdrawal, where permitted by law.

Once the service has been fully performed, the right of withdrawal may be lost only where the consumer expressly requested early performance and acknowledged in advance that full performance would result in the loss of that right.

Nothing in these Terms restricts any mandatory consumer right. Any cancellation terms specific to an ongoing bespoke engagement will be stated in its written proposal.

11. Nature and limitations of the services

The services provide independent research, analytical interpretation and decision context. They do not constitute portfolio management, brokerage, trade execution, a suitability assessment or a personal recommendation to enter into, modify or close a particular transaction.

No forecast, profile interpretation, price level, temporal window or scenario is guaranteed to be accurate or to produce a particular result.

12. Intellectual property and permitted use

Unless otherwise agreed in writing, the service provider retains all intellectual property rights in the methodologies, analytical frameworks, report structures, visual materials and underlying research tools used to produce the deliverables.

The client receives a personal, non-exclusive and non-transferable right to use the delivered material for their own internal purposes.

The material may not be resold, publicly distributed, published, modified for commercial use or represented as the client’s own work without prior written permission.

References to or excerpts from a deliverable may not be published in a manner that removes relevant context, qualifications or disclaimers.

13. Confidentiality

Information supplied by the client will be used only to assess, perform and administer the engagement, subject to the Privacy Policy and applicable law.

The service provider will not intentionally publish a client’s identity, personal data or commissioned deliverable without permission, except where disclosure is legally required.

14. Liability

The service provider will perform the agreed work with reasonable professional care.

To the extent permitted by applicable law, the service provider shall not be liable for trading losses, investment losses, lost profits or decisions made by the client in reliance on research or analytical interpretations.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including mandatory consumer rights or liability arising from fraud or wilful misconduct.

15. Events beyond reasonable control

Neither party shall be responsible for delay or failure caused by circumstances reasonably beyond their control. If such circumstances materially affect delivery, the parties will seek an appropriate revised schedule or other reasonable solution.

16. Applicable law and jurisdiction

These Terms are governed by Spanish law.

Any dispute shall be submitted to the courts determined by applicable procedural and consumer-protection rules. Nothing in this section limits any mandatory rights or jurisdiction available to consumers.
